And now the moment you've all been waiting for ....
We didn't have an official hearing. First off the Assistant Principal called me at work three times today. First she wanted to make sure I still wanted to have the hearing. Then she said she wanted to meet with me. Then she called back when she found out I had a lawyer and said she'd see me at the hearing.
It really threw them to find out we had a lawyer. So when we got to the hearing their lawyer took my lawyer outside to have a talk with him. After the heat shut off I could hear everything they were saying. He basically told my lawyer that if we went forward with the hearing the entire transcript would be on the Enzo's permanent record. He also said that the Principle, Assistant Principal, and the D.A.R.E Officer would give statements saying why they considered this a bomb threat. He told my lawyer that they didn't have as much stuff on the other kid and he lost the hearing so the chances of us winning were pretty much non-existent.
He said they were willing to offer my son alternative placement instead of the 180 day suspension. So, then my lawyer came and repeated what I'd already heard and recommended that I go with that. I agreed with him. If Christopher lost then there was no way that we were going to win. I didn't want all that on his record - and since my main concern was that he be back in a supervised school setting during the day and they were offering me that I took that deal.
It was win-win mostly. My lawyer said we could go ahead and fight it, and lose this hearing then we could go to court and appeal the decision there but he didn't think we had a very good chance of winning that.
I'm happy that Enzo gets to go back to school. He will make a contract with the school and if he behaves himself he'll get to return to regular classes. Plus, he gets to make up the work he missed while in JDC and he won't
get further behind. I think Christopher is just screwed. They really didn't like the fact that he wouldn't take responsibility for his actions and that his Mom wasn't very reasonable.
The Assistant Superintendent said she was proud of Enzo for admitting to what he did and not trying to blame other people. I'm proud of him for that as well. This fact helped him get a good deal. It's not exactly what I wanted but it will work. ;D
